By enrolling in, enabling, or otherwise participating in Rider Assist as a helper (“Helper”), you acknowledge and agree to the following terms.
1. Voluntary Participation
Rider Assist is a voluntary community feature provided by District 76 Riders (“D76”) that allows participating riders to request or offer assistance for non-emergency roadside situations.
Participation as a Helper is entirely voluntary. You are never required to accept, respond to, travel to, or complete any request for assistance.
You may decline or discontinue assistance at any time for any reason, including concerns regarding safety, location, weather, traffic, equipment, another person’s behavior, or your own ability to safely provide assistance.
2. Rider Assist Is Not an Emergency Service
Rider Assist is not an emergency response, towing, roadside assistance, medical, law enforcement, rescue, dispatch, or professional repair service.
If a situation involves an accident, injury, medical emergency, fire, crime, dangerous roadway conditions, immediate threat to personal safety, or another emergency, contact the appropriate emergency services.
Do not rely upon Rider Assist when emergency or professional assistance is required.
3. Independent Community Members
Helpers are independent community members.
Helpers are not employees, agents, contractors, representatives, partners, joint venturers, emergency responders, mechanics, towing providers, or service providers of D76.
D76 does not direct or control how a Helper responds to or performs assistance.
Participation in Rider Assist does not create an employment, agency, partnership, fiduciary, professional, or other special relationship between D76 and any Helper, requester, or other person.
4. No Compensation or Commercial Relationship
Unless separately and expressly permitted by D76, Rider Assist is intended for voluntary community assistance.
D76 does not guarantee or provide compensation to Helpers and is not responsible for any payment, reimbursement, expense, tip, exchange, or other arrangement made between users.
Any private arrangement between a Helper and requester is solely between those individuals.
5. Your Responsibility and Judgment
You are solely responsible for determining whether you can safely and lawfully respond to a request.
You agree not to respond if doing so would place you or another person at unreasonable risk.
You are responsible for:
- operating your motorcycle or other vehicle safely and legally;
- determining whether roadside conditions are safe;
- using tools and equipment appropriately;
- remaining within your knowledge, experience, and abilities;
- complying with applicable traffic and other laws;
- maintaining appropriate licenses, registration, insurance, and equipment; and
- discontinuing assistance when conditions become unsafe.
Never perform a repair, transport, medical procedure, recovery, or other task you are not qualified, equipped, or legally permitted to perform.
6. No Screening or Guarantee of Users
Unless D76 expressly states otherwise, D76 does not guarantee the identity, background, qualifications, driving history, criminal history, insurance status, intentions, trustworthiness, condition, or behavior of any Rider Assist participant.
Profiles, verification indicators, badges, ratings, account history, or other information displayed by D76 must not be interpreted as a guarantee of safety, character, competency, or reliability.
You are responsible for deciding whether you are comfortable meeting or assisting another user.
7. Location and Personal Information
Rider Assist may share information necessary to facilitate assistance, which may include approximate or precise location information, profile information, vehicle or motorcycle information, contact information, assistance details, or other information submitted through the service.
By participating as a Helper, you consent to the collection, processing, and disclosure of information reasonably necessary to operate Rider Assist in accordance with D76 policies.
You agree to use information received through Rider Assist solely for purposes reasonably related to the assistance request and not to misuse, publish, retain unnecessarily, harass, stalk, solicit, or otherwise exploit another participant's information.
8. Assumption of Risk
You understand that responding to roadside assistance requests may involve significant risks, including but not limited to:
traffic; impaired or distracted drivers; roadside hazards; adverse weather; poor visibility; unsafe locations; mechanical failures; tools and equipment; fire; hazardous materials; property damage; theft; confrontation with other persons; bodily injury; permanent disability; and death.
You voluntarily assume all known and unknown risks associated with participating in Rider Assist, to the fullest extent permitted by applicable law.
9. Release and Waiver
To the fullest extent permitted by applicable law, you release and waive claims against District 76 Riders, its owners, founders, organizers, administrators, moderators, officers, directors, employees, volunteers, affiliates, sponsors, partners, vendors, service providers, technology providers, contractors, licensors, successors, assigns, and other Rider Assist participants (collectively, the “Released Parties”) arising from or relating to your voluntary participation in Rider Assist.
This includes, to the fullest extent permitted by law, claims involving personal injury, death, property damage, theft, loss, delay, failed assistance, negligent acts or omissions, interactions with other users, travel to or from an assistance location, and use or attempted use of tools, equipment, vehicles, motorcycles, parts, or information.
Nothing in this Agreement excludes liability that cannot legally be excluded or waived.
10. Limitation of Liability
To the fullest extent permitted by applicable law, D76 and the Released Parties will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to Rider Assist.
D76 does not guarantee that a request will be received, that a Helper will respond, that location information will be accurate, that communications will function, that assistance will be successful, or that Rider Assist will be continuously available.
11. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless D76 and the Released Parties from claims, liabilities, losses, damages, judgments, costs, and reasonable expenses arising from or relating to your conduct while participating in Rider Assist, your violation of this Agreement, your violation of applicable law, or injury or damage caused by your acts or omissions.
12. No Warranty
Rider Assist is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind to the fullest extent permitted by applicable law.
D76 makes no warranty regarding the availability, safety, reliability, accuracy, identity, qualifications, conduct, response time, or outcome of any Rider Assist interaction.
13. Right to Refuse or End Assistance
You may refuse, leave, or discontinue an assistance interaction at any time.
Your personal safety takes priority over completing a Rider Assist request.
14. Suspension and Removal
D76 may restrict, suspend, or remove access to Rider Assist at its discretion, including for suspected misuse, unsafe behavior, harassment, fraud, policy violations, or conduct that may endanger the community.
15. Severability
If any provision of this Agreement is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect to the extent permitted by applicable law.
16. Acknowledgment
By selecting “I Agree & Become a Helper”, you confirm that:
- you have read and understood this Agreement;
- you are participating voluntarily;
- you understand Rider Assist is not an emergency or professional roadside service;
- you understand D76 does not guarantee or supervise other participants;
- you understand participation may expose you to serious injury, property damage, or death;
- you voluntarily assume the risks associated with participation; and
- you agree to the releases, limitations, and other terms contained in this Agreement.
