Before submitting a request through Rider Assist, you (“Requester”) acknowledge and agree to the following terms.

1. Community Assistance

Rider Assist is a voluntary community feature provided by District 76 Riders (“D76”) that allows riders to request non-emergency assistance from other participating community members.

Submitting a request does not guarantee that anyone will respond or provide assistance.

2. NOT FOR EMERGENCIES

Rider Assist is not an emergency service.

Do not use Rider Assist as a substitute for 911, emergency medical services, law enforcement, fire services, professional towing, roadside assistance, or other appropriate emergency or professional services.

If you or another person is injured, in immediate danger, involved in a serious crash, stranded in a dangerous roadway location, or experiencing another emergency, contact the appropriate emergency services immediately.

3. Helpers Are Independent Community Members

People responding through Rider Assist are independent community members volunteering to help.

They are not employees, agents, contractors, representatives, mechanics, towing providers, emergency responders, or service providers of D76.

D76 does not direct, supervise, train, certify, control, or guarantee Helpers.

4. No Guaranteed Response or Outcome

D76 does not guarantee:

  • that any Helper will receive your request;
  • that anyone will respond;
  • a particular response or arrival time;
  • that a Helper will remain available;
  • that the Helper has particular tools, equipment, skills, experience, insurance, licenses, or qualifications;
  • that assistance will solve your problem; or
  • that Rider Assist or its communications and location services will operate without interruption or error.

You remain responsible for arranging professional or emergency assistance when appropriate.

5. Your Responsibility for Your Safety

You are responsible for assessing your surroundings and remaining in a safe location while waiting for assistance.

Do not wait in an unsafe roadway, traffic lane, hazardous shoulder, dangerous neighborhood, severe weather condition, or other location merely because a Rider Assist request has been submitted.

If circumstances become unsafe, leave the area when reasonably possible and contact the appropriate authorities or professional services.

6. Interaction With Helpers

You decide whether to accept assistance from a responding Helper.

You are not required to allow anyone to:

  • operate your motorcycle or vehicle;
  • perform repairs;
  • use tools on your property;
  • transport you;
  • transport your motorcycle or property;
  • enter your home, garage, or other private property; or
  • perform any action with which you are uncomfortable.

You may refuse or terminate an interaction at any time.

7. No Screening or Guarantee

Unless D76 expressly states otherwise, D76 does not guarantee the identity, background, qualifications, driving history, criminal history, insurance status, intentions, trustworthiness, condition, or behavior of any Helper or other participant.

Profiles, badges, verification indicators, ratings, activity, or other information displayed through D76 do not constitute a guarantee or endorsement of an individual's safety, character, competency, or reliability.

Exercise appropriate judgment when interacting with anyone you meet through Rider Assist.

8. Location and Information Sharing

To connect you with nearby Helpers, Rider Assist may process and share information associated with your request, potentially including your approximate or precise location, profile information, motorcycle or vehicle information, request description, contact information, and other information reasonably necessary to facilitate assistance.

By submitting a request, you authorize D76 to disclose such information to potential or responding Helpers as reasonably necessary to operate Rider Assist and in accordance with applicable D76 policies.

Only provide information you are authorized and comfortable providing.

9. Authorization Concerning Your Property

If you voluntarily permit a Helper to interact with your motorcycle, vehicle, equipment, or other property, you acknowledge that such permission is given by you directly to that Helper and not by D76.

You are responsible for deciding what work, if any, another person may perform.

D76 does not inspect, supervise, approve, or guarantee repairs or other assistance.

10. Assumption of Risk

You understand that roadside situations and interactions with other individuals involve inherent and unpredictable risks.

These risks may include traffic, weather, roadside hazards, mechanical failure, improper repairs, property damage, theft, bodily injury, confrontation, negligent acts or omissions, transportation risks, and death.

You voluntarily assume all known and unknown risks associated with requesting, receiving, accepting, or declining Rider Assist assistance to the fullest extent permitted by applicable law.

11. Release and Waiver

To the fullest extent permitted by applicable law, you release and waive claims against District 76 Riders, its owners, founders, organizers, administrators, moderators, officers, directors, employees, volunteers, affiliates, sponsors, partners, vendors, service providers, technology providers, contractors, licensors, successors, assigns, and other Rider Assist participants (collectively, the “Released Parties”) arising from or relating to your use of Rider Assist.

This includes, to the fullest extent permitted by law, claims involving personal injury, death, property damage, theft, loss, failed or delayed assistance, unsuccessful or improper repairs, interactions with Helpers, transportation, location information, communications, negligent acts or omissions, and use or attempted use of tools, parts, vehicles, motorcycles, or equipment.

Nothing in this Agreement excludes liability that cannot legally be excluded or waived.

12. Limitation of Liability

To the fullest extent permitted by applicable law, D76 and the Released Parties will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to Rider Assist.

Rider Assist is merely a technology and community feature intended to help connect participating users. D76 is not responsible for the conduct of users before, during, or after an interaction.

13. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless D76 and the Released Parties from claims, liabilities, damages, losses, judgments, costs, and reasonable expenses arising from or relating to your conduct, information you provide, violation of this Agreement, violation of applicable law, or injury or damage caused by your acts or omissions.

14. No Warranty

Rider Assist is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind to the fullest extent permitted by applicable law.

D76 makes no representation or warranty regarding availability, safety, response times, accuracy of location information, identity or qualifications of Helpers, repairs, transportation, communications, or outcomes.

15. Reporting Problems

Unsafe behavior, harassment, fraud, threats, misuse of personal information, or other inappropriate conduct should be reported to D76.

Reporting an incident to D76 is not a substitute for contacting law enforcement or emergency services when appropriate.

16. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect to the extent permitted by applicable law.

17. Acknowledgment

By selecting “I Understand & Request Help”, you confirm that:

  • you have read and understood this Agreement;
  • your request is not being submitted as a substitute for emergency services;
  • you understand that Helpers are independent community members;
  • you understand D76 does not guarantee a response, Helper, repair, service, or outcome;
  • you consent to necessary location and request information being shared with potential Helpers;
  • you understand the risks associated with roadside assistance and meeting other users;
  • you voluntarily assume those risks; and
  • you agree to the releases, limitations, and other terms contained in this Agreement.
