PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
By accepting this Agreement or voluntarily participating in a motorcycle ride, meetup, event, activity, or other motorcycle-related interaction organized, listed, promoted, coordinated, discovered, or facilitated through District 76 Riders (“D76”), you acknowledge and agree as follows.
1. Motorcycling Is Inherently Dangerous
Motorcycling involves substantial and unavoidable risks of serious bodily injury, permanent disability, paralysis, property damage, and death.
Risks include, without limitation:
- collisions;
- traffic;
- negligent or reckless drivers;
- other riders;
- varying rider skill levels;
- road debris;
- potholes and roadway defects;
- weather;
- reduced visibility;
- wildlife;
- mechanical failure;
- tire failure;
- equipment failure;
- navigation errors;
- construction;
- road closures;
- fatigue;
- communication errors;
- actions of pedestrians;
- emergency vehicles;
- acts or omissions of participants and third parties; and
- known and unknown or foreseeable and unforeseeable hazards.
No motorcycle activity can be made completely safe.
2. Voluntary Participation and Assumption of Risk
Your participation is voluntary.
You knowingly and voluntarily assume all risks associated with participation, including risks caused by your own conduct, other participants, road conditions, third parties, equipment, and ordinary negligence to the fullest extent permitted by applicable law.
3. You Are Solely Responsible for Riding Your Motorcycle
You control your motorcycle at all times.
You alone determine whether to participate and determine your speed, following distance, lane position, route, maneuvers, stopping decisions, and riding behavior.
No ride lead, sweep, organizer, administrator, moderator, member, or other participant has authority over the operation of your motorcycle.
“Ride your own ride” applies at all times.
If you believe something is unsafe, do not do it.
You may slow down, stop, leave a group, change routes, or decline participation at any time.
4. Rider Responsibilities
You are responsible for:
- possessing legally required licenses or endorsements;
- maintaining legally required insurance;
- complying with traffic laws;
- operating a legally compliant motorcycle;
- maintaining your motorcycle;
- determining its roadworthiness;
- selecting and wearing appropriate protective equipment;
- evaluating your experience and ability;
- remaining physically and mentally capable of riding; and
- refraining from riding while impaired by alcohol, drugs, medications, fatigue, illness, or another condition affecting safe operation.
D76 does not inspect or certify compliance with these requirements.
5. Group Riding
Group rides involve additional risks.
The presence of a ride lead, sweep, route, briefing, pace group, hand signal, regroup point, GPS route, or other organizational feature does not transfer responsibility for your motorcycle or safety to another person.
Ride leads and sweeps are participating riders volunteering to help coordinate the group.
They are not professional guides, instructors, traffic controllers, safety officers, or guarantors of participant safety.
6. District 76 Does Not Control Riders
Participants operate independently.
D76 does not control, supervise, train, certify, inspect, or continuously monitor participants.
Membership, profiles, badges, verification indicators, participation history, or other information should not be interpreted as a representation concerning someone's riding ability or safety.
7. Routes and Information
Routes, GPS files, maps, road descriptions, ratings, weather information, hazard reports, recommendations, and event information may contain errors or become outdated.
Road conditions can change without warning.
You are responsible for determining whether a route remains safe, legal, open, and appropriate.
8. Third-Party Events
Some activities displayed or promoted through D76 are organized by independent third parties.
Listing or promoting such an activity does not make D76 its organizer, operator, supervisor, or safety provider.
9. Passengers
If you carry a passenger, you are responsible for determining whether doing so is legal and appropriate.
You are responsible for your passenger to the extent provided by applicable law.
You agree not to represent that D76 has evaluated or approved your ability to carry passengers.
10. Medical Emergencies
Any participant may contact emergency services or attempt reasonable assistance during an emergency, but nobody affiliated with D76 has an obligation to provide medical treatment, rescue, transportation, or emergency response.
You authorize emergency assistance to be requested on your behalf when another person reasonably believes it necessary.
You are responsible for medical, ambulance, transportation, towing, rescue, or other resulting expenses.
11. No Insurance Provided
D76 does not provide motorcycle, automobile, health, accident, medical, life, property, roadside assistance, or liability insurance for participants.
You are responsible for maintaining whatever insurance you consider appropriate or that applicable law requires.
12. Release and Waiver of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE DISTRICT 76 RIDERS AND ITS FOUNDERS, OWNERS, OFFICERS, DIRECTORS, ADMINISTRATORS, MODERATORS, EMPLOYEES, MEMBERS, VOLUNTEERS, RIDE LEADS, SWEEPS, ORGANIZERS, EVENT HOSTS, AFFILIATES, SPONSORS, PARTNERS, PROPERTY OWNERS, VENDORS, CONTRACTORS, SERVICE PROVIDERS, SUCCESSORS, ASSIGNS, AND OTHER PERSONS ACTING ON THEIR BEHALF (“RELEASED PARTIES”) FOR CLAIMS ARISING FROM OR RELATING TO YOUR PARTICIPATION.
TO THE FULLEST EXTENT PERMITTED BY TENNESSEE LAW, THIS RELEASE INCLUDES CLAIMS ARISING FROM ORDINARY NEGLIGENCE OF A RELEASED PARTY.
This Agreement does not release gross negligence, reckless or intentional misconduct, or liability that applicable law prohibits from being waived.
13. Covenant Not to Sue
To the fullest extent permitted by applicable law, you agree not to bring or maintain a claim against a Released Party concerning risks or claims released under this Agreement.
14. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Released Parties from claims, liabilities, damages, losses, judgments, expenses, costs, and reasonable attorneys' fees arising from:
- your participation;
- your operation of a motorcycle;
- your conduct;
- injuries or property damage caused by you;
- your violation of law;
- your violation of D76 policies; or
- claims asserted through or because of your actions.
15. No Reliance
You acknowledge that you are not relying upon D76, another participant, a ride lead, or an organizer to determine whether participation is safe for you.
16. Electronic Acceptance
By accepting this Agreement, you confirm:
- you are at least 18;
- you have read the entire Agreement;
- you understand its terms;
- you understand motorcycling can cause serious injury or death;
- you voluntarily assume the risks;
- you understand you are giving up important legal rights; and
- you intend electronic acceptance to have the same legal effect as your handwritten signature.
D76 may record your identity, account, agreement version, acceptance date and time, IP address, device/browser information, and related audit information.
17. Severability
If any portion of this Agreement is unenforceable, it shall be modified or enforced to the greatest extent permitted by law without invalidating the remainder.
18. Governing Law
This Agreement shall be governed by Tennessee law to the extent permitted by applicable law.
By selecting “I Understand the Risks & Agree”, you voluntarily accept this Safety Waiver and Assumption of Risk.
