District 76 Riders Ride Waiver and Release of Liability

Please read this agreement carefully before accepting it. By accepting this waiver, you acknowledge that you understand the risks involved in motorcycling and voluntarily assume those risks.

Motorcycling is inherently dangerous

Motorcycling is an inherently dangerous activity that involves significant risks, including serious bodily injury, permanent disability, death, and property damage. These risks exist whether you ride alone or with others and may result from road conditions, weather, traffic, wildlife, mechanical failure, your own actions, the actions of other riders, or the actions of third parties.

Group riding introduces additional risks, including varying rider skill levels, changing traffic conditions, close proximity to other motorcycles, communication errors, navigation mistakes, and unexpected hazards. You knowingly and voluntarily assume all risks associated with participating in any District 76 Riders ride or event, whether known or unknown, foreseeable or unforeseeable.

You are solely responsible for yourself

You alone are responsible for determining whether you are capable of participating safely.

Before every ride, you are responsible for:

  • Holding a valid motorcycle endorsement or license.

  • Maintaining any insurance required by law.

  • Ensuring your motorcycle is safe, properly maintained, and roadworthy.

  • Wearing protective gear appropriate for your own safety.

  • Being physically and mentally fit to ride.

  • Not riding while impaired by alcohol, drugs, medication, fatigue, or any other condition that could affect safe operation.

You are solely responsible for complying with all traffic laws, speed limits, and regulations. Nothing communicated by District 76 Riders, a ride lead, volunteer, organizer, or another participant requires or encourages you to violate the law or operate your motorcycle beyond your own abilities.

Ride your own ride

You alone determine your speed, following distance, lane position, and riding decisions.

You may leave a ride, slow down, stop, or choose not to participate at any time for any reason.

No member, organizer, volunteer, or ride lead has authority over your riding decisions, and you acknowledge that you are operating your motorcycle independently at all times.

District 76 Riders is an informal community

District 76 Riders is an informal social community of motorcycle enthusiasts.

District 76 Riders is not:

  • A business

  • A motorcycle club with supervisory authority

  • A tour operator

  • A commercial event organizer

  • A transportation provider

  • A riding school

  • A safety organization

  • A law enforcement agency

Rides are simply gatherings of individuals who choose to ride together.

Ride leads and organizers are unpaid volunteers who may suggest routes or meeting locations for convenience only. They are not guides, instructors, supervisors, safety officers, or agents responsible for your safety. They do not inspect motorcycles, verify licenses or insurance, evaluate rider ability, monitor road conditions, or guarantee the safety of any route.

Any route information, riding suggestions, GPS files, maps, event descriptions, or safety discussions are provided solely as informal opinions and may be inaccurate, incomplete, or outdated.

Assumption of risk

You voluntarily assume all risks associated with participating in any District 76 Riders activity, including risks arising from:

  • Your own actions or decisions.

  • The actions of other participants.

  • Road or weather conditions.

  • Mechanical failures.

  • Wildlife.

  • Traffic.

  • Navigation errors.

  • Equipment failures.

  • Acts or omissions of third parties.

  • Any other foreseeable or unforeseeable hazard.

You understand that participation is entirely voluntary.

Release of liability

To the fullest extent permitted by applicable law, you release, waive, discharge, and covenant not to sue District 76 Riders and its founders, administrators, moderators, members, volunteers, organizers, ride leads, event hosts, sponsors, property owners, and anyone acting on behalf of District 76 Riders for any claim, demand, lawsuit, liability, loss, injury, death, property damage, cost, or expense arising out of or related to your participation in any District 76 Riders activity.

This release applies regardless of whether the claim arises from ordinary negligence or any alleged act or omission of a released party.

This release does not apply where prohibited by law and does not release liability for gross negligence, reckless misconduct, intentional misconduct, or any liability that cannot legally be waived under Tennessee law.

Medical treatment

If an emergency occurs, any participant may contact emergency services or seek medical assistance on your behalf.

You authorize such assistance and accept full responsibility for all resulting medical expenses, transportation costs, and related charges.

District 76 Riders has no obligation to provide medical assistance, emergency response, transportation, insurance, or rescue services.

Insurance

District 76 Riders does not provide health insurance, motorcycle insurance, liability insurance, accident insurance, or any other insurance coverage for participants.

You acknowledge that you are solely responsible for obtaining and maintaining any insurance you choose to carry.

Indemnification

You agree to defend, indemnify, and hold harmless District 76 Riders and all released parties from any claim, lawsuit, liability, damage, expense, or attorney fees arising out of:

  • Your participation in a ride or event.

  • Your operation of a motorcycle.

  • Damage or injury caused by your actions.

  • Claims brought by your passenger, family members, heirs, or anyone asserting rights through you.

Electronic acceptance

By accepting this agreement, you acknowledge that:

  • You have carefully read and understood this waiver.

  • You are at least 18 years of age.

  • You are voluntarily accepting this agreement.

  • You understand you are giving up important legal rights.

  • You intend your electronic acceptance to have the same legal effect as a handwritten signature.

Your acceptance may be recorded along with your name, account information, date and time of acceptance, IP address, browser information, and other technical information necessary to document your acceptance.

If this agreement is updated, continued participation may require acceptance of the revised version.
