These Terms of Service (“Terms”) constitute a legally binding agreement between you and District 76 Riders (“District 76,” “D76,” “we,” “us,” or “our”) governing your access to and use of d76riders.com, associated websites, applications, services, features, communications, events, community tools, and other services provided by District 76 (collectively, the “Services”).
By creating an account, accessing or using the Services, electronically accepting these Terms, or participating in activities facilitated through District 76, you acknowledge that you have read, understood, and agree to these Terms and all policies incorporated into them.
If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to create an account or participate in Services requiring an account.
By using District 76, you represent that:
- you are at least 18 years old;
- you have legal capacity to enter into these Terms;
- information you provide is truthful and reasonably accurate; and
- your use of the Services does not violate applicable law.
We may refuse, suspend, or terminate access when we reasonably believe these requirements have not been met.
2. Your Account
You are responsible for activity conducted through your account and for maintaining the confidentiality of your credentials.
You may not impersonate another person, create an account using another person's identity without authorization, share an account in a manner that compromises security, circumvent restrictions or suspensions, or use District 76 for fraudulent or unlawful purposes.
Notify D76 promptly if you believe your account has been compromised.
D76 is not responsible for losses resulting from unauthorized account access that was not caused by D76 to the extent permitted by law.
3. Community Guidelines
Participation is subject to the District 76 Community Guidelines.
D76 may moderate content and may warn, restrict, suspend, or permanently remove users when we determine that conduct violates our policies, threatens community safety, exposes D76 or others to unreasonable risk, or is otherwise inconsistent with the purposes of the community.
Enforcement decisions are made at D76's discretion.
4. District 76 Is a Community Platform
District 76 provides technology and community features that allow motorcycle enthusiasts to discover and communicate with other people, roads, rides, events, businesses, organizations, and resources.
Unless expressly stated otherwise, D76 does not organize, operate, supervise, control, certify, inspect, approve, or guarantee activities, riders, events, routes, businesses, Helpers, users, or third parties appearing through the Services.
A listing, profile, badge, verification indicator, recommendation, sponsor designation, partnership, link, rating, or other appearance on District 76 should not be interpreted as a guarantee of safety, qualifications, identity, reliability, legality, insurance, quality, or suitability.
5. Motorcycle Activities and Assumption of Risk
Motorcycling is inherently dangerous and may result in serious injury, permanent disability, property damage, or death.
Your participation in motorcycle activities is voluntary.
You are responsible for your motorcycle, equipment, insurance, licensing, physical condition, riding ability, speed, lane position, following distance, route selection, compliance with law, and every decision you make while riding.
Your participation in rides and motorcycle-related activities is additionally governed by the District 76 Safety Waiver & Assumption of Risk, which is incorporated into these Terms.
6. Events and User-Organized Activities
Events appearing on District 76 may be created by D76 users, businesses, outside organizations, promoters, or other third parties.
Unless D76 expressly identifies itself as the organizer, the appearance or promotion of an event through District 76 does not mean D76 owns, operates, controls, supervises, endorses, or assumes responsibility for that event.
Event details may be inaccurate, incomplete, canceled, delayed, or changed without notice.
You are responsible for confirming event information directly with the appropriate organizer when necessary.
7. Roads, Routes, Maps, Weather and Location Information
Road descriptions, maps, routes, GPS data, ratings, weather information, road conditions, distances, directions, hazard information, and similar content are informational only.
Information may be incomplete, outdated, inaccurate, unavailable, or affected by circumstances beyond D76's control.
Never rely exclusively upon District 76 for navigation, weather, emergency information, road closures, or safety-critical decisions.
You are responsible for independently evaluating conditions and determining whether a road or route is appropriate for you.
8. Rider Assist
Rider Assist is a community connection feature for voluntary, non-emergency assistance between users.
Rider Assist is not an emergency response service, roadside assistance company, towing service, repair service, dispatch service, transportation service, medical service, or law enforcement service.
D76 does not guarantee that assistance will be available, requested, accepted, safe, successful, appropriate, or timely.
Participation as a Helper requires acceptance of the Rider Assist Helper Agreement.
Submitting assistance requests is governed by the Rider Assist Assistance Request Agreement.
Those agreements are incorporated into these Terms when you use the corresponding Rider Assist features.
9. Emergency Rider Card and Safety Features
Emergency Rider Card and similar features are informational tools and are not medical devices, emergency response systems, medical advice, medical records systems, or substitutes for professional emergency services.
D76 does not guarantee that emergency information is complete, accurate, available, accessed, transmitted, received, or relied upon by emergency responders or other persons.
Users are responsible for maintaining accurate information.
No person should delay contacting emergency services because of a D76 feature.
10. Communications Between Users
D76 may provide messaging, group chats, comments, feeds, profiles, and other communication features.
D76 does not control or guarantee statements made by users.
Interactions or transactions arising from communications through D76 are undertaken at your own risk.
You are responsible for exercising appropriate judgment before meeting, riding with, buying from, selling to, assisting, or otherwise interacting with another person.
11. Marketplace
Unless expressly stated otherwise, D76 is not the buyer, seller, broker, dealer, payment provider, guarantor, or party to transactions between users.
Buyers and sellers are responsible for determining the legality, safety, authenticity, condition, ownership, price, delivery, payment, and suitability of items.
D76 does not guarantee marketplace listings or transactions.
12. Shops, Sponsors, Partners and Third Parties
District 76 may display businesses, sponsors, partners, attorneys, shops, service providers, products, websites, or other third parties.
Their inclusion does not create a warranty or guarantee concerning their services.
Third parties are responsible for their own products, representations, conduct, services, privacy practices, and legal obligations.
Any transaction or relationship between you and a third party is between you and that third party.
13. Merchandise and Purchases
Products sold directly through District 76 or a designated fulfillment provider are subject to the terms presented at purchase.
Product appearance, availability, pricing, sizing, production times, shipping, and other details may change.
Third-party fulfillment providers remain responsible for services they independently provide.
14. User Content
You retain ownership of content you create.
By submitting content to District 76, you grant D76 and its successors and assigns a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, distribute, resize, format, transmit, and otherwise use that content as reasonably necessary to operate, improve, protect, and promote District 76 and the community.
You represent that you own or possess the rights necessary to submit your content.
You may not submit content that violates intellectual property, privacy, publicity, contractual, or other rights.
15. Content Moderation
D76 may, but has no obligation to, review, moderate, refuse, restrict, remove, preserve, or disclose content where reasonably necessary to operate the Services, enforce policies, comply with law, investigate abuse, or protect D76, users, or others.
Failure to remove particular content does not constitute endorsement.
16. Intellectual Property
Except for user-owned content and third-party materials, the District 76 name, branding, logos, software, designs, graphics, databases, organization, and original content are owned by or licensed to District 76.
Nothing in these Terms grants permission to use D76 trademarks, branding, or intellectual property except as necessary to use the Services normally.
17. Prohibited Conduct
You may not use District 76 to:
- violate applicable law;
- threaten, harass, stalk, intimidate, or exploit another person;
- commit or facilitate fraud;
- distribute malicious software;
- interfere with platform security;
- scrape or harvest information in unauthorized ways;
- circumvent access restrictions;
- misuse another person's personal or location information;
- impersonate another person;
- promote dangerous activity contrary to D76 safety policies; or
- use the Services in a manner reasonably likely to harm D76, its infrastructure, users, partners, or community.
18. No Professional Advice
Information appearing on District 76 is provided for general informational and community purposes.
Nothing provided through District 76 constitutes legal, medical, mechanical, financial, insurance, safety, law-enforcement, emergency-response, or other professional advice.
Consult an appropriate qualified professional when such advice is required.
19. No Warranty
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
D76 DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, RELIABILITY, AND FITNESS FOR A PARTICULAR ACTIVITY.
We do not guarantee uninterrupted operation, preservation of data, accuracy of information, availability of another user, or any particular result from using District 76.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DISTRICT 76 AND ITS FOUNDERS, OWNERS, OFFICERS, DIRECTORS, ADMINISTRATORS, MODERATORS, EMPLOYEES, VOLUNTEERS, RIDE LEADS, ORGANIZERS, AFFILIATES, SUCCESSORS, ASSIGNS, SPONSORS, PARTNERS, VENDORS, CONTRACTORS, LICENSORS, TECHNOLOGY PROVIDERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOREGOING PARTIES WILL NOT BE LIABLE FOR INJURY, DEATH, PROPERTY DAMAGE, LOST PROPERTY, LOST DATA, LOST PROFITS, FAILED COMMUNICATIONS, THIRD-PARTY CONDUCT, USER INTERACTIONS, MOTORCYCLE ACTIVITIES, RIDER ASSIST INTERACTIONS, EVENTS, ROUTES, OR OTHER LOSSES ARISING FROM OR RELATING TO USE OF DISTRICT 76.
Nothing in these Terms excludes liability that cannot legally be excluded.
21. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless District 76 and its founders, owners, officers, directors, administrators, moderators, employees, volunteers, ride leads, organizers, affiliates, successors, assigns, sponsors, partners, vendors, contractors, licensors, technology providers, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from or relating to:
- your use of District 76;
- your conduct;
- your motorcycle activities;
- your interaction with another user;
- your content;
- your violation of these Terms;
- your violation of applicable law; or
- infringement or violation of another person's rights.
22. Release Concerning Other Users
To the fullest extent permitted by applicable law, you release D76 and its protected parties from claims arising from disputes, interactions, transactions, rides, meetings, assistance, or other dealings between you and another user or third party.
23. Service Availability and Changes
D76 may add, modify, suspend, restrict, or discontinue features or Services at any time.
We do not guarantee continued availability of any particular feature.
24. Suspension and Termination
D76 may restrict, suspend, or terminate accounts or access when reasonably necessary to enforce these Terms, protect users or the community, address security concerns, comply with law, or protect D76.
You may stop using District 76 and delete your account according to available account controls.
25. Transfer and Successors
D76 may assign these Terms and transfer operation of the Services, associated assets, accounts, and data to a successor entity, including a corporation, nonprofit organization, or other entity established to operate District 76, subject to applicable privacy law.
26. Electronic Communications and Acceptance
You consent to receive agreements, disclosures, notices, and other communications electronically where permitted by law.
Electronic acceptance has the same intended effect as a handwritten signature.
D76 may record the policy version, account identifier, date, time, IP address, browser/device information, and other reasonable audit information associated with acceptance.
27. Governing Law and Venue
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
To the extent permitted by applicable law, disputes arising from these Terms or the Services shall be brought in an appropriate state or federal court located in Tennessee, and you consent to personal jurisdiction and venue there.
28. Severability
If any provision is determined to be invalid or unenforceable, it shall be enforced to the maximum extent legally permitted and the remaining provisions will remain in effect.
29. No Waiver
Failure by D76 to enforce any provision does not waive our right to enforce it later.
30. Entire Agreement
These Terms, together with policies and supplemental agreements expressly incorporated into them, constitute the agreement between you and District 76 concerning the Services.
31. Changes
We may update these Terms as District 76 evolves.
Material changes may require renewed electronic acceptance.
The version and effective date displayed above identify the Terms governing your use.
